REGULATIONS for CS:GO Skins

§1 GENERAL INFORMATION
  1. The owner of the Application and the GamerHash.com portal available at www.gamerhash.com and all its components is CoinAxe Sp. z o.o.
  2. The Regulations supplement the Master Regulations with respect to their possibility to purchase CS:GO Skins through the Portal. In matters not regulated by the Regulations, the provisions of the Master Regulations shall apply.
  3. In all cases where the Regulations refer to a specific time, the appropriate time is Central European Summer Time (CEST).
  4. In all cases indicated in the Regulations as requiring contact with CoinAxe Sp. z o.o. (notification, reporting, other), the appropriate contact channel is the e-mail box: [email protected].
  5. The use of the functionalities described in the Regulations is not subject to any additional fees, except for the fees described in the Regulations
  6. The Regulations and the services described herein are addressed to entities already holding a User Account.
  7. A User who would like to make an exchange in the Skin Store must have an account in www.steampowered.com portal.
§2 DEFINITIONS
  1. The terms used in the Regulations and written in capital letters shall have the meaning as indicated below. Other terms written in capital letters and not regulated hereinbelow shall have the meaning described in the Master Regulations:
    1. Web Application -the platform available to the User at www.gamerhash.com after logging in;
    2. CoinAxe Sp. z o.o.CoinAxe Sp. z o.o., a limited liability company with its registered office in Poznań (60-771), ul. Marii Konopnickiej 16/3a, registered in the register of entrepreneurs of the National Court Register under KRS number: 0000702796, whose registration files are kept by the District Court Poznań - Nowe Miasto i Wilda in Poznań, VIII Department of the National Court Register, NIP: 7831767156, REGON: 368702100;s
    3. GamerHash Store an online platform available in the Web Application at https://gamerhash.com/shop and directly from the Mobile Application;
    4. GHX lub Token - ERC-20 GamerCoin token;
    5. Computer– a device within the meaning of the Rules, limited to electronic devices intended for the processing of information (data) presented in a digital form, being a stationary device or a portable device, with the exception of the Mobile Device or other similar devices;
    6. User Account – an individuated part of the Portal, identified by the User login and provided with a password set individually by the User;
    7. Portal – GamerHash portal available at gamerhash.com;
    8. Rules - these Rules;
    9. Portal - GamerHash portal located at www.gamerhash.com;
    10. Steam Portal - portal available at www.steampowered.com ;
    11. CS:GO Skins -skins that allow for customizing firearms, knives, or character models in the game Counter-Strike: Global Offensive which are products that do not require physical shipment and which may be acquired by the User through the exchange of Bitcoin, GUSD or GHX;
    12. Regulations - shese Regulations;
    13. Master Regulations - the Regulations of the GamerHash Portal available at https://gamerhash.com/pl/rules;
    14. Skins Store - a separate part of GamerHash Store, accessible only in the Web Application, through which you may access CS:GO Skins and exchange Bitcoin, GUSD or GHX for CS:GO Skins;
    15. Steam ID 64 - an identifier that the User can retrieve from the Steam Portal user account;
    16. Steam Trade URL - a URL that the User can download from the Steam Portal user account;
    17. Device - the Computer, the Mobile Device or a similar electronic device with Internet access;
    18. USD - United States dollar;
    19. User – a natural person with full legal capacity, a legal person or an organizational unit with legal capacity having the User Account. A natural person who does not have full legal capacity, in particular a minor, may be the User only with the prior consent of an authorized legal representative;
§3 PROCESS OF EXCHANGE FOR CS:GO SKINS
  1. Once The User has accumulated enough Bitcoin, GUSD or GHX to exchange them for CS:GO Skins, it has the right to exchange them for CS:GO Skins through the Skins Store.
  2. By clicking on a particular CS:GO Skin, the User can read a brief description of that CS:GO Skin
  3. Exchanges for CS:GO Skins at the Skin Store can be made using Bitcoin, GUSD or GHX
  4. In order to exchange Bitcoin, GUSD or GHX for CS:GO Skin, the User must go to the Skin Store section of the GamerHash Store in the Web Application. After selecting the CS:GO Skin, the User should click on "Claim Now".
  5. The User is then required to:
    1. enter its Steam ID 64 in the “Your Steam ID 64 (DEC)” window;
    2. enter Steam Steam Trade URL in the “Your Steam Trade URL” window;
    3. pconfirm that the User's profile in the Steam Portal is a public profile;
    4. accept the Regulations;
    5. move on to the next step by clicking the appropriate button.
  6. In the next step the User selects the wallet from which it intends to make the exchange (Bitcoin or GUSD or GHX), as well as the previously assigned PIN (authorization), and then expresses its willingness to make an exchange by clicking on the appropriate button. When the User accepts the exchange, it will be notified of the success of the transaction and acknowledges that the acceptance will result in a reduction of its Bitcoin or GUSD or GHX balance in the amount indicated for each CS:GO Skin. The value of each CS:GO Skin is expressed in USD (United States dollar). After receiving confirmation of the transaction, the CS:GO Skin will appear in the “Orders” tab in the User's Account in the Portal.
  7. In order to confirm the transfer of a CS:GO Skin to the User Account in the Steam Portal, the User must accept the transfer of the CS:GO Skin to the User Account in the Steam Portal. To do so, the User is required to go to the "Orders" tab in the Portal and order the transfer by clicking the "Pay Out" button and accepting the exchange offer in the individual User account in the Steam Portal. In the event the User has not completed the transfer of the CS:GO Skin within ten (10) minutes from clicking on the “Pay Out” button, the User must restart the transfer process, i.e. by completing the steps outlined in this paragraph once again. If the User fails to transfer the CS:GO Skin to the User account in the Steam Portal within 30 (thirty) days from the date of the exchange referred to in §3 clause 6 hereinabove, the User acknowledges that the CS:GO Skin may be forfeited due to the lack of technical capabilities for its transfer. THE USER REPRESENTS THAT IT WILL NOT 3 CLAIM ANY RIGHTS TOWARDS COINAXE SP. Z O.O. IN CONNECTION THEREWITH, INCLUDING ASSERTING ANY CLAIMS.
  8. All payments related to the exchange of Bitcoin, GUSD or GHX for CS:GO Skin are made upon acceptance of the particular order. CoinAxe does not allow orders to be performed on a deferred basis or under the creation of a negative balance of Bitcoin or GUSD or GHX.
  9. CoinAxe reserves the right to run promotions on CS:GO Skins. When promotions are introduced, they are not subject to cumulation unless the rules of a particular promotion state otherwise.
§4 RIGHT OF WITHDRAWAL AND CLAIMSE
  1. With the acceptance of the above-described exchange for the CS:GO Skin, which constitutes digital content, the User, in particular being a consumer, agrees that CoinAxe Sp. z o.o. will perform the service resulting from this transaction before the expiry of the period entitling the User-consumer to withdraw from the concluded agreement and, at the same time, the User (including being a consumer) acknowledges that it then has no right to withdraw from this agreement. BY ACCEPTING THE REGULATIONS AND MAKING AN EXCHANGE FOR A CS:GO SKIN, YOU EXPRESSLY AGREE TO LOSE YOUR RIGHT OF WITHDRAWAL FROM THE AGREEMENT AND WAIVE ALL RIGHTS ASSOCIATED THEREWITH.
  2. CoinAxe Sp. z o.o. is liable towards the User who is a consumer as defined in Article 221 of the Civil Code, under the statutory warranty for defects to the extent set forth in the Civil Code
  3. The Users may lodge any claims regarding CS:GO Skins in writing by registered mail to the registered office of CoinAxe Sp. z o.o. or by e-mail to: [email protected]. The claim shall indicate the return address or e-mail address to which a reply should be sent
  4. Claims will be handled by CoinAxe Sp. z o.o. no later than within 14 (in words: fourteen) days from the date of lodging the claim.
  5. The User who lodges a claim shall provide the data enabling the identification of the claimed order and a contact address (e-mail, correspondence address, telephone number) in the content of the complaint so that contact with it in order to inform about the result of the complaint procedure is possible, and additionally it should indicate the reason for the claim, the content of the request and description of circumstances justifying the claim.
  6. Claims concerning the principles of providing services electronically by CoinAxe, with regard to the functionality of the Portal described in the Regulations may be submitted electronically to the email address: [email protected].
  7. A claim shall contain data which make it possible to effectively inform the person lodging the claim about the manner in which the claim has been handled. For this purpose, the claimant shall indicate it full name and correspondence address in the claim.
  8. Claims shall be handled within 30 days from the date of their lodging.
§5 REPRESENTATIONS OF THE USER
  1. The User acknowledges that:
    1. a properly executed Bitcoin, GUSD, or GHX exchange for a CS:GO Skin will lead to the transfer of that CS:GO Skin to the Individual User account in the Steam Portal;
    2. the correct transfer of the CS:GO Skin is only possible to an individual user account in the Steam Portal with a public character, i.e. with the account option "public" selected for the user in the Steam Portal;
    3. the transfer of the CS:GO Skin to the individual User account in the Steam Portal may not be possible due to the Steam Portal's exchange and transaction restrictions, which are 4 described at the following link https://help.steampowered.com/pl/faqs/view/451E-96B3-D194-50FC;
    4. CoinAxe Sp. z o.o. is an independent entity from the owner, administrator or entity managing the portal www.steampowered.com and is obliged to comply with all its regulations and recommendations when using the above-described portal.
§5 AMENDMENT TO THE REGULATIONS
  1. CoinAxe reserves the right to amend the Regulations in the event of:
    1. the occurrence of important technical and organizational reasons, in particular the emergence of new technologies or IT systems that affect the Regulations;
    2. changes in generally applicable legal regulations affecting the Regulations;
    3. the need to adapt the Regulations to court rulings or administrative decisions;
    4. the need to remove any ambiguities that may exist in the Regulations,
    5. changes in the principles of operation or development of the Portal or the Web Application, including their components, in a manner affecting the provisions of the Regulations
    6. changes of address details, names, identification numbers, electronic addresses or links provided in the Regulations.
  2. Amendments to the Regulations will not:
    1. cause the User to pay remuneration or additional fees,
    2. violate the essence of the concluded agreement for the provision of services by electronic means and other agreements between the User and CoinAxe Sp. z o.o.
  3. CoinAxe Sp. z o.o. will notify the User of the amendment to the Regulations no later than 14 (in words: fourteen) days prior to the date of the amendment coming into force, via a push-up notification which will appear from the time the amendment is published until the amendment comes into force, when the Web Application is launched and the User logs in for the first time from the amendment. In case of acceptance of the new wording of the Regulations, the User will be obliged to actively express their will in this respect. Simultaneously with the provided information, CoinAxe Sp. z o.o. will publish the updated wording of the Regulations.
  4. The amended Regulations will come into force as at the date set forth in a notification and publication, unless the User within 14 (fourteen) days of such notification provides by e-mail a declaration about the lack of consent to being bound by the amended Regulations, which will be tantamount to the lack of will to use the Skin Store.
